Understanding the H-2B Visa Cap Limitation
- Each fiscal year (Oct - Sept), there are a limited number of H-2B Visas granted approval
- Currently, the US Congress has set the annual "Cap" or limit at 66,000 visas
- 33,000 H-2B visas are granted for workers starting between October 1 and March 31
- 33,000 H-2B visas are granted for workers starting between April 1 and September 30
- Occasionally, the US Congress will approve to temporarily increase the cap
- Once the "Cap" is reached, USCIS may still accept petitions for workers exempt from the "Cap"
